Driving Under the Influence of Alcohol

A person is guilty of D.U.I. if he/she drives, operates or is in physical control of the movement of a vehicle after drinking an amount of alcohol that makes him/her incapable of safe driving.

A person is also guilty of D.U.I. if he/she drives, operates or is in physical control of the movement of a vehicle and that person’s blood alcohol level is .08% or higher within 2 hours of driving the vehicle.

A person is also guilty of D.U.I. if he/she drives, operates or is in physical control of the movement of a vehicle if there is any amount of a Schedule I, II, or III controlled substance in the individual’s blood or if the individual is under the influence of any drug that impairs the individual’s ability to drive safely.

D.U.I. - FOR MINORS

A person under the age of 21 is guilty of D.U.I. if he/she drives, operates or is in physical control of the movement of a vehicle with a blood alcohol level of .02% or higher.
